Terms&Conditions

1. Definitions

  • Provider / We / Vying.io — VYING CLOUD TECHNOLOGIES SRL, based in Romania, operating the Vying.io platform and cloud infrastructure.
  • Client / User / You — any natural or legal person who uses, tests, purchases, or accesses our cloud desktops (DaaS), VPS, network services, or the Vying.io website.
  • Services — all cloud desktops, virtual servers, backup systems, private networks, remote support, and any related products offered by Vying.io.
  • Agreement — these Terms & Conditions, forming the legal basis for using our services.

2. Acceptance of Terms

By accessing Vying.io, submitting a trial request, using our cloud desktops, VPS, or network services, you confirm that you have read, understood, and agreed to these Terms & Conditions.

If you do not agree, you must stop using our services immediately.

3. Scope of Services

3.1 Cloud Desktops (DaaS)

We provide hosted Windows desktops running on enterprise servers. Clients may request specific resources (CPUs, RAM, storage). Performance may vary depending on usage, connectivity, and workload.

3.2 VPS & Server Hosting

We offer virtual servers with customizable resources. Clients receive administrator/root access and are responsible for the software they install.

3.3 Support & Assistance

We provide real-engineer support via phone, WhatsApp, and remote access tools. Response time varies depending on workload and priority.

3.4 Data Backups

We perform regular backups and snapshots. Rollback or restore actions are performed on request and within technical limits.

3.5 Trial Services

We offer a 30-day free trial. The trial includes a fully functional cloud desktop or VPS. No payment or contract is required to start the trial.

4. Client Obligations

Clients must:

  • Provide accurate and honest information during signup.
  • Use services only for legal, legitimate purposes.
  • Keep all login credentials secure and confidential.
  • Not attempt to access systems that do not belong to them.
  • Not use Vying.io services to send spam, host illegal content, or attack networks.
  • Ensure that any licensed software they install is legally obtained.

Failure to comply may lead to suspension or termination.

5. Payment & Billing

  • Services are billed in EUR.
  • Payment is made via bank transfer.
  • Invoices are issued monthly or annually, as agreed.
  • Free trial does not require payment or credit card details.
  • No refunds are provided for partial months or unused services.

6. Service Availability

We aim to provide high uptime and stability, but we do not guarantee 100% uptime.

Planned maintenance, hardware failures, ISP issues, or other external factors may affect availability.

In such cases, we act as quickly as possible to restore normal operation.

7. Data Handling & Deletion

  • When a service is terminated, the associated virtual machine, desktop, or server is permanently deleted.
  • System logs and activity records may be kept for up to 90 days for security and compliance.
  • After 90 days, all remaining data is removed unless required by law.

8. Liability Limitation

To the extent permitted by law:

  • Vying.io is not responsible for data loss caused by client errors, misconfigured software, malware, or improper use.
  • Vying.io is not liable for indirect damages, lost profits, or business interruption caused by downtime, network issues, or third-party failures.
  • Clients are responsible for maintaining their own backups beyond the standard backups we offer.

Nothing in this Agreement limits liability for intentional wrongdoing or fraud.

9. Termination

Either party may terminate services at any time with written notice.

We may suspend or terminate access if:

  • The client breaches these Terms
  • Illegal activity is detected
  • Billing issues cannot be resolved
  • Security of the infrastructure is at risk

Upon termination, data is deleted according to Section 7.

10. Changes to Terms

We may modify these Terms & Conditions when necessary to reflect legal, technical, or business updates.

Updated Terms will be published on Vying.io with a revised “Last updated” date.

Continued use of the service means acceptance of the updated Terms.

11. Governing Law

These Terms & Conditions are governed by Romanian and EU law.

Any disputes will be resolved by Romanian courts unless otherwise agreed in writing.
